Many factors must be considered when making an accident claim, in order to arrive at an appropriate legal demand for compensation. Factors that are fundamental to an accident claim include:

• The geographic area—where did the accident occur? Regional variations in medical bills, wage scales, and costs of living make a significant difference.
• Liability—does the responsibility for the accident lie with only one party? Which party? Or is the liability shared?
• Property damage—for example, in motor vehicle accidents, was your vehicle damaged? To what extent? Do you have estimates of the cost of repairing the vehicle? Or must it be replaced?
• Personal property—Was any other personal property damaged in the accident? What is its value?
• Injuries or fatalities—

  • Was there a hospital admission?
  • What was the length of treatment?
  • Was there a delay in seeking treatment?
  • What is the prognosis?
  • Was there any disfigurement?
  • Is further treatment needed, or are the injuries resolved?
  • Did anyone have a preexisting injury that was aggravated by the accident?
  • What were the expenses following a fatality? (medical, burial, funeral)
• Medical expenses—What are they so far? What are the expected expenses?
• Wage or other income losses—What have you lost due to the accident? Are you back at work, or will there be continuing wage/income loss? In fatalities, what is the expected loss of that individual’s income?
