Premises Liability

Premises liability law deals with the injuries to individuals that occur on the premises of someone else, such as:

  • a store—e.g., a grocery store, a shopping mall
  • an amusement park
  • the home of a friend or acquaintance
  • near a construction site
  • in a parking lot or a parking structure
  • at a stadium or other sports venue
  • in an apartment complex
  • at a hotel or motel
  • in a restaurant, nightclub or bar
  • at a public park, museum, or gallery
  • swimming pools

A Duty to Maintain Safe Premises

The owners of property have a legal duty to maintain the property so that individuals who visit it—whether as guests or workers—will not be harmed. Unfortunately, millions of people are hurt every year in premises liability incidents such as:

  • an assault or rape on the property, due to inadequate security
  • collapsing balcony, floor, ceiling, etc.
  • construction equipment malfunction
  • dog bites
  • explosions and fires
  • falling objects
  • malfunctioning amusement park rides
  • slip and fall injuries
  • exposure to toxic substances such as chemicals, gas, or mold

We don’t usually expect to be injured following simple actions as attending a party or convention, shopping with our families, visiting a park or going to a movie. However, unsafe premises have caused harm to many people—children, adults, and the elderly.

Negligence of the Premises Owner and/or Management

A premises liability injury (or death) may be caused by slippery floors, a fire or electrical hazard, poor construction standards, an attacking animal, unsafe or messy conditions, inadequate security, and a wide variety of other conditions that may be due to the negligence of the property’s owner and/or management.

When an injury occurs to an individual on someone else’s premises, the injured party may be eligible for financial compensation for his or her losses (e.g., medical bills, lost work time, rehabilitation costs, disfigurement, job loss, pain and suffering) when the injury is found to be due to the negligence of the premises’ owner/management.
